Other General Rules

1.

Tenants who have received a total compensation which is of a total amount more than the statutory compensation as calculated under the LTO agree to give up their rights for public housing assistance for the next two years. Such tenants are only allowed to submit fresh application for public rental housing and other public housing assistance after the expiry of the two years period.

   
2.

Trespassers occupying premises in the project area, who move in after the project freezing survey will be evicted without any payments or rehousing.

   
3.

Cash incentive related to basic cash compensation under the LTO will be 10% instead of 70% if a person has received cash compensation from the URA or the Housing Society previously. Such person will not be entitled to receive the said minimum payment of HK$70,000 and HK$80,000.

   
4.

In cases where the Housing Society acquires a property by private treaty, which is tenanted, and that property is occupied for a mixture of domestic and non-domestic uses, the Housing Society will determine whether the tenancy is domestic or non-domestic in accordance with the principles set out in LTO.

   
5.

If the tenant refuses to accept our cash compensation or rehousing offer and/or fails to sign surrender agreement, the Housing Society will recover vacant possession of the affected premises in accordance with the prevailing law.
