2: What
is the difference between the compensation for a principal tenant
and an ordinary tenant? If a principal tenant leases out rooms to
sub-tenants after renting the whole flat from the owner, how does
the Housing Society compensate the principal tenant should there
be vacant rooms?
Answer:
If
a principal tenant lives in an affected unit, in addition to basic
cash compensation and cash incentive based on the saleable area
of his occupied portion, a principal tenant whose tenancy commences
before the project occupancy survey will be offered 12 months' profit
rent (if any) subject to his acceptance of the offer within a specified
period.
Absentee principal tenants whose tenancies commence before the date
of project occupancy survey will be offered HK$10,000 plus an incentive
provided they accept the offer within a specified period. Absentee
principal tenants whose tenancies commence after the project occupancy
survey will be offered HK$5,000 without any cash incentive.
A principal tenant will be offered rental reduction where sub-tenants
surrender leased portions or terminated for any reason before the
principal tenant delivers vacant possession.
If a unit is wholly rented by a principal tenant, the interests
of the vacant rooms belong to the principal tenant.
Half of the total amount of the above-mentioned basic cash compensation,
incentive, and profit rent (for principal tenants cases) will be
paid upon the execution of surrender agreement and the remaining
half will be paid after the delivery of vacant possession.
The above cash compensation is intended to cover for the costs of
moving to alternative accommodation and therefore, no ex-gratia
removal allowance will be offered to tenants who receive cash compensation.
